AbstractThe European contract law flows into the member States’ legal systems throughout the directives and regulations issued by the European institutions and, moreover, through the judgements passed by the European Court of Justice. Due to all this activity, sometimes happens that member States can have to deal with laws which don’t match their legal traditions and cultures. This situation lets us think about the destiny of some traditional legal categories. The present work takes into consideration, in particular, some of the main legal categories of the Italian contract law related to the European law. Another section is dedicated to the impact of European law on the freedom of contract principle, seen from the point of view both of “business to consumer” and “business to business” contracts. Last, the work contains a mention of some problems caused by the interference with the antitrust legislation.
