The object of this research is to analyze the evolution of the liability limit for air transport passengers during the last eight years since the signing of the Convention for the unification of Certain Rules Relating to International Carriage by air, Signed at Warsaw on 12 October 1929. We will try to give an overview of the discipline that enable us to understand the metamorphosis undergone by the institute, in the light of technological progress and, above all, of the changed sensibility towards the passengers protection. The liability limit was born as an instrument of protection for an infant industry which was protected from the disastrous consequences of probable accidents. From then on, the institute has shown its limits towards the growth of air transport, the technological progress of aviation and the need to assure adequate compensation, going beyond the original vision of balance between carrier and passenger.
