Several factors have contributed over the last twenty years toward modifying the European financial system. Globalization of markets, introduction of the single currency, the removal of borders for offering of services, and, not least, the development of information technologies and communication which have in turn created significant changes also in the system of payments. One of the most evolved technologies is electronic money (“e-money”) in the form of the memorization of a monetary value on a file or hard disk of a PC and on a smart card. The use of this new instrument of payment has had influences on our very conception of money, defined no longer as a material good that is perceivable, but rather in the direction of the concept of the “cashless society”, both upon the speed and security of exchanges and, remarkably, payments. The present study has focused its attention on three issues held to be especially relevant to a complete examination of the topic. Specifically, the primary objective of the work is to analyze the issues related to settlement effectiveness of this new form of payment with respect to ordinary forms pursuant to art. 1277 c.c. [civil code]. Further investigated is the nature of institutes issuing the single currency, with special attention dedicated to the examination of profiles of connection with bank guidelines, as well as the very same definition of the concept of electronic money as contained in national and community norms.
